Terms of Service

1. Acceptance

By using Kinaara you agree to these terms.

2. What Kinaara provides

A community management platform. We provide the tools, organizations are responsible for how they use them.

3. Account responsibilities

• You are responsible for maintaining the security of your account
• Organizations are responsible for the accuracy of their member data
• Do not use Kinaara for illegal purposes or to harass members

4. Payments

• Subscription fees are billed monthly or annually
• Member dues payments are processed by Stripe and go directly to the organization's connected Stripe account
• Kinaara does not hold or process member dues on behalf of organizations
• Refunds for subscription fees are considered on a case-by-case basis

5. Data and privacy

Refer to our Privacy Policy. You own your data. We do not sell it.

SMS communications are governed by our SMS Messaging Policy in the Privacy Policy. By providing your phone number to your organization, you acknowledge that your organization may enroll you in SMS notifications subject to your consent.

6. Termination

You can cancel your account at any time. We can suspend accounts that violate these terms. On cancellation, you can export your data (feature coming soon).

7. SMS Messaging Terms

By enrolling in SMS notifications through Kinaara:

• You consent to receive text messages from your organization via Kinaara's toll-free SMS service.
• Message frequency: approximately 2 to 4 messages per month, varying by organization activity.
• Message and data rates may apply.
• To opt out: reply STOP at any time. You will receive one final confirmation message.
• To get help: reply HELP at any time.
• To re-enroll: reply START.

Kinaara's SMS service is provided via Twilio. By using SMS features you also agree to Twilio's Acceptable Use Policy available at twilio.com/legal/aup.

Organizations using Kinaara's SMS features are responsible for:

• Obtaining proper consent from members before enrolling them in SMS notifications
• Ensuring SMS communications comply with applicable law including TCPA and any applicable state regulations
• Maintaining records of member consent for a minimum of 4 years

Kinaara provides SMS as a transactional communication tool only. Organizations may not use Kinaara's SMS service for:

• Unsolicited marketing messages
• Messages to individuals who have opted out
• Any content that violates Twilio's Acceptable Use Policy or applicable law

Kinaara reserves the right to suspend SMS access for any organization that violates these terms.

8. Limitation of liability

Kinaara is provided as-is. We are not liable for data loss, payment disputes between organizations and their members, or service interruptions.

9. Changes to these terms

We will notify users of material changes by email with 30 days notice.
